Welcome to Kizuna AI! These Terms of Service ("Terms") govern your access to and use of the Kizuna AI mobile application (the "Application" or "App") operated by us ("we," "our," or "us").

Please read these Terms carefully before using the Application. BY ACCESSING OR USING THE APPLICATION, YOU AGREE TO BE BOUND BY THESE TERMS. IF YOU DISAGREE WITH ANY PART OF THE TERMS, YOU DO NOT HAVE PERMISSION TO ACCESS OR USE THE APPLICATION.

1. Eligibility

To use Kizuna AI, you must:

  • Be at least 17 years of age (or the minimum age of digital consent in your jurisdiction).

  • Have the legal capacity to form a binding contract under applicable law.

  • Not be barred from using the Application under the laws of any applicable jurisdiction.

2. Description of Service

Kizuna AI is an AI-powered dating assistant designed to help users improve their dating profile engagement and messaging skills. Key features include:

  • AI Coach Chat: Custom conversational models to strategize chat replies.

  • Profile Review: Scoring systems and textual analysis of dating profiles.

  • Dating Simulator: Practice conversations with AI-driven character archetypes.

  • Relationship Memory: Tools to log match details, traits, and follow-ups.

3. Disclaimers Regarding AI-Generated Content

You acknowledge and agree that:

  • AI Nature: All chat replies, profile advice, analysis scores, and simulator dialogues are generated dynamically using artificial intelligence models (such as Google Gemini).

  • Accuracy Disclaimer: AI models can make errors, produce "hallucinations," or generate responses that may be inaccurate, incomplete, or out of context. You must exercise common sense and your own judgment when applying advice or strategies suggested by our AI features.

  • No Professional Advice: The Application provides personal communication coaching only. We do not provide professional, legal, therapeutic, psychiatric, or relationship counseling services.

  • Liability Exclusion: We are not responsible or liable for any real-world outcomes, relationship dynamics, communication misunderstandings, or dating platform bans that result from your use of AI-generated suggestions or bios.

4. Subscriptions and Payments

Certain features within Kizuna AI are designated as premium and require an active paid subscription (managed via Superwall SDK and Apple In-App Purchases).

A. Billing and Auto-Renewal

Subscription purchases are processed directly through your Apple ID account. Payment will be charged to your iTunes Account at confirmation of purchase. Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period.

B. Managing Subscriptions

You can manage or cancel your auto-renewal subscription at any time within your iPhone's Apple ID account settings after purchase.

C. Refunds

All in-app purchases and subscriptions are handled by Apple. Refund requests must be submitted directly through Apple Support. We do not process refunds directly.

5. Code of Conduct and Acceptable Use

You agree not to use the Application for any unlawful, harmful, or abusive purposes. Specifically, you agree not to:

  • Use the Application to generate harassing, abusive, threatening, defamatory, or hateful content.

  • Upload images, screenshots, or profile assets containing explicit, pornographic, or non-consensual imagery.

  • Attempt to bypass, hack, or reverse-engineer the API limits, gating mechanisms, or source code of the Application.

  • Use any automated scripts, bots, or scrapers to extract data or interact with our services.

We reserve the right to immediately terminate your access to the Application, without prior notice, if you violate any provision of these Terms.

6. Intellectual Property Rights

The Application, including its original source code, UI designs, system prompts, logos, graphics, and underlying technical configurations, is the exclusive intellectual property of us and our licensors. These assets are protected by copyright, trademark, and other proprietary laws. You are granted a limited, non-exclusive, non-transferable, and revocable license to use the Application strictly for personal, non-commercial purposes.

7. Limitation of Liability

TO the MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL WE, OUR DIRECTORS, EMPLOYEES, PARTNERS, OR AGENTS, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your use of or inability to use the Application.

  • Any AI-generated suggestions, advice, or bio optimizations.

  • Unauthorized access, alteration, or deletion of your chat history or Firestore records.

  • Conduct or content of any third party in connection with the Application.

8. Governing Law

These Terms shall be governed and construed in accordance with the laws of [Insert Your State/Country], without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
